AUSSIE FITNESS Hire and Sales

Terms & Conditions of Hiring

 

In agreeing or undertaking a hire with Aussie Fitness, the following Terms & Conditions apply:

 

1. Hire Periods 

1 Month or 3 Month Hire Plans.

 

2. Rental Fees

Fees are represented as Monthly fees to allow customers comparison with other rental companies, However rental fees are charged up front for the entire 1 or 3 months.

 

3. Payment Plan

Payment of the full 1 or 3 Month is required upfront.

 

4. Other Charges

The following charges may apply:

Delivery Fee - (FREE Delivery is for Ground level deliveries only Available on the Sunshine Coast, Brisbane & surrounding suburbs only, two story homes and stairs will incur an extra charge between $80-$140  )

Collect Fee – (Does not apply if you decide to purchase your item. FREE collection is for Ground level collection only Available on the Sunshine Coast Brisbane & Surrounding suburbs only. All other suburbs are the responsibility of

The customer to coordinate & pay for any return costs)

Other charges also may apply WITH OUT NOTICE if customer breaches any of the covenants Listed in point 5.

 

5. Customer Covenants

Customer agrees that:

(A) The Equipment remains the property of Aussie Fitness until such times that is fully purchased at RRP or REG price by the

Customer;

(B) Customer shall not sell, charge, pledge or part with the Equipment;

(C) The item should only be kept indoors at all times;

(D) Customer shall use Equipment in a careful and proper manner at all times;

(E) Should the item become damaged in anyway, the customer will pay for the relative cost of repairs or pay the balance payment required to purchase the item.

(F) At time of return or collection to Aussie Fitness, the item shall be clean & dust free. An item that has not be thoroughly cleaned will not be accepted by Aussie Fitness & further charges will apply (Cleaning Fee $70 and/or Recollection Fee $140).

(G) The customer shall keep the equipment at the address listed on the hire contract. Should the customer relocate, they must notify Aussie Fitness immediately. It should be noted that collection fee charged may differ to the original delivery fee charged if the customer has relocated to a different suburb.

(H) Aussie Fitness will only collect equipment from Sunshine Coast, Brisbane or Surrounding suburbs. Should the customer relocate outside of these suburbs it is the customer’s responsibility to organize the safe transport of the equipment at their own expense.

(I) Customer shall notify Aussie Fitness immediately if any court judgment or order is levied against Customer or the property of Customer, or if a petition is presented for the liquidation of the Customer or a receiver is appointed or a scheme of arrangement is proposed;

(J) Customer shall permit Aussie Fitness or its agents to enter the premises where Equipment is located, provided reasonable notice is provided, in order to inspect Equipment or carry out maintenance to the equipment.

(K) The same conditions for collection of the item apply as when the item was first delivered. For example; Aussie Fitness Only conducts deliveries or collections in the customer’s suburb between 10am – 3pm Monday / Wednesday & Friday. If the customer was available to accept the delivery of the item between these times than they must be available for the item to be collected between these times. Should this not be the case, Aussie Fitness will charge the cost of a special service which is a Minimum $80.00 – maximum $140.00

(L) Customer shall cover the following costs should the item (including non-expandable materials) not be returned to Aussie Fitness in full working & condition satisfactory to:

If the machine is lost / stolen / not returned $ Replacement costs of the machine at full RRP or REG value minus any hire fees paid.

Non-Expandable Items (Instruction Booklet, $ 35.00 and/or $ of Safety Key etc)

 

6. Warranty

Aussie Fitness will register the warranty for this product on your behalf at the commencement of your hire period. Your warranty will cover manufacturer’s faults & not maintenance which needs to be carried out by the customer in accordance with the supplier/ manufacturers instruction manual.

 

7. Maintenance

Customer will be responsible for product maintenance in accordance with the supplier / manufacturers instruction manual.

 

8. Early Termination of Agreement

Notwithstanding the rental period, Aussie Fitness expressly reserves the right of early termination of the rental agreement, which may be exercised on demand and at the discretion of Aussie Fitness. In such an event customer shall forthwith return Equipment to Aussie Fitness. The applicable rental shall be adjusted and payable on a pro rata basis. For the purpose of pro rating, a week

Shall be of seven days and a month shall be of 30 days. Aussie Fitness will only terminate such an agreement if it believes the product is not be maintained or has been damaged by the customer. The customer will pay for the relative cost of repairs or pay the balance payment required to purchase the item.

Aussie Fitness does not refund or credit early rental returns by the customer should the customer decide they no longer use or need the machine.

 

9. Liability

The products liability for function shall remain the responsibility of the supplier at all times unless such functions have ceased performing as required due to causes by the customer.

 

10. Damage or Loss

The item is owned by the customer from the date it is purchased & received. Should the item be damaged or suffer any loss it shall be born by the customer & subsequently the hire agreement will be null & void.

 

11. Aussie Fitness Usage Policy: Strictly domestic and personal use only

The 1 or 3 month hire is only available to customers for domestic use only. If the item has been used in a commercial environment such as Personal Training Studios / Gyms / Corporate Offices etc the hire agreement will become null & void and the customer will have to pay the outstanding balance on the machine.

 

12. Aussie Fitness Warning:

1). Users must read the user's instruction manual (provided by the supplier / manufacturer before using the machine.

2). Aussie Fitness is not responsible for any loss or injury caused whatsoever.

3). Equipment program settings have been prepared without taking into account personal objectives or physical needs.

Before using the equipment you should obtain medical advice as to the suitability of this equipment for your health needs. (Pulse monitors on machines are not of medical standard)

4). Please ensure speeds are suitable for the user as unsuitable speeds may cause injury.

 

13. General

A) This Agreement constitutes the entire agreement between the Customer and   Aussie Fitness.

B) Statements or representations made by agents, employees, distributors and dealers of Aussie Fitness which add to or vary this agreement or the related documentation do not constitute warranties by Aussie Fitness, do not bind Aussie Fitness and should not be relied upon.

D) This Agreement may only be modified in a written amendment signed by an authorized Manager of Aussie Fitness.

E) If any provisions of this Agreement are unenforceable, all other will remain in effect.

F) This Agreement shall be governed by the laws of the state of Queensland, Australia.

G) By signing this agreement & any other contracts, the customer is stating that they accept, understand & agree with the terms & conditions of the hire product.
